How to get a new and transfer title in Texas


A title is a certificate of ownership issued by the state of Texas that proves you legally own your vehicle. When purchasing a new vehicle, you must apply for a title in your name. Additionally, if you sell your vehicle or give it away as a gift, you must apply for a title transfer. When the vehicle owner dies, a title transfer must also take place. To avoid penalties from the state of Texas, register and transfer the title of your vehicle within 20 business days after the purchase.

Titles on New Vehicles

In Texas, it is a requirement of the licensed dealer that sold the vehicle to submit the paperwork necessary to obtain a title. They must also pay the necessary fees in your behalf. Request a receipt of this transaction with your name on it within 20 business days. Title Transfers on Used Vehicles

No matter if you purchased a used vehicle or received one as a gift, you must transfer the title into your name. Bring the following documents and the correct amount of fees required to your local County Tax-Assessor Collector's Office:

  1. Current Title
    Make sure that the seller/donor has signed the title over to you in the space provided. If the vehicle is less than ten years old, include the federal odometer disclosure.
  2. Bill of Sale
    Some titles will have space to write down the date of sale and price paid. If yours does not, include a bill of sale that has been signed and notarized by both owners.
  3. Odometer Disclosure Statement
    If your title does not include this information, provide a separate document if the vehicle is less than ten years old.
  4. Vehicle Title Application
    This document must be signed by the seller.
  5. Vehicle Registration Receipt
  6. Original or Copy of Liens on Vehicle
    If the vehicle has been financed or there was a security agreement drawn up, these documents must be provided.
  7. Proof of Insurance (Liability)

Title Transfers Following Death of Owner

When the owner of a vehicle dies, the title is usually transferred to the heirs, unless another person is specified in the will. Sometimes they may be required to fill out an Affidavit of Heirship. Copies of the death certificate and will may also be needed. A statement of the content of the will, if notarized, will be accepted in place of the actual will.
