How to get a new and transfer title in Maryland


The state of Maryland issues a certificate of title for vehicles that prove you are the legal owner of said vehicle. If you ever purchase a new vehicle, you must apply for a title. If you have purchased a used vehicle, or receive a vehicle as a gift, you must transfer the title into your name. Additionally, when a vehicle's owner dies and a new owner takes possession, a title transfer must be completed.

New Vehicle Title Application

A licensed dealer that sells you a new vehicle will usually submit the required paperwork and fees to transfer the title. However, if you want to handle this process yourself, you may. Refer to the Maryland Vehicle Title and Registration Information and the Vehicle Registration and Titling Questions sections on the Motor Vehicle Administration (MVA) website.

Title Transfer on a New Vehicle

Whether you have received a vehicle as a gift, or have purchased one used, you must transfer the title into your name. Fill out the following documents, and submit the correct amount of fees to your local MVA facility:

  1. Current Title
    Seller must fill out the title to indicate you as the new owner.
  2. Application for Certificate of Title
    If the vehicle's title was issued in the state of Maryland, you may use this for your application. Simply complete the required information under 'Application for Title and Registration'.
  3. Bill of Sale
    This is required as proof of purchase, and must be signed by both the new owner, and the previous owner. If the vehicle is less than 8 years old, or was sold for at least $500 below the current book value, the bill of sale should be notarized.
  4. Odometer Disclosure Statement
    The title may include this information, but if not, you must include this in your documentation.
  5. Maryland Safety Inspection Certificate
    This document is issued by the Maryland State Police and confirms that the vehicle is up to date with Maryland's safety standards. This document is only valid for 90 days after it is issued.

  7. Gift Certification Form (if vehicle is being given as a gift)
    The MVA stipulates that vehicles can only be gifted to family members. If the last names on the form do not match, separate proof of the relationship between family members must be given. If the gift is between an aunt/uncle to a niece/nephew, a separate document, a Certified Statement, has to be included as well.

  • Security Interest Filing Fee -- $20 for each lien filed
  • Titling Tax ý 6% of the fair market value or the sale price, minimum $38.40

Title Transfers After Death of Owner

When the owner of a vehicle dies, the title is most often transferred to the heirs. However, check the will to make sure another owner has not been specified. The documents needed for this transfer and the fees required are very similar to those mentioned above. Determine how the heirs settled the estate. They may need to submit court orders, a copy of the death certificate, and a will, if there is one, or simply a notarized statement of the contents.
